Comments: My family used to run a rec. riding facility for all ages and levels 45min. south of Ottawa, Ontario Canada. Young riders was a major part of what we were trying to support. It really was a family event. Safety was number one, we were only operation fully 1 day a week. We got into trouble with the Municipality due to a small number of troubled members of our community with nothing better to do. Long story short we were shut down and only family is technically allowed to ride on our 64 acres of partially forested wonderland, all running in one direction. That was several years ago. It hasn't stopped our family but it has discouraged may of our riding family friends. We are losing riding areas all over North America every year. I was disappointed to find out the troubles that you are facing in your area. As a friend and fellow rider, we must work together to secure the future of the sport we so dearly love.

I started riding at the age of 5 and still ride today. Riding kept me off the streets and it now has become a family affair. My 4yr old is riding his CRF50 everyday. The problem, My 6yr old daughter wants an ATV. I told her about this law and she can't understand why she is allowed to ride her power wheels atv, but can't have a real one.

In my 31years of riding motorcyles, I have never seen anyone try to eat, lick, suck or cook a motorcycle.

Please tell Malcolm Smith that there are a slew of people behind him on selling kids bikes despite that stupid law. Good for him! Lead poisoning in bikes? The next baby I see teething on a dirt bike is going to be the first. The next thing that they are going to tell us is that drinking the gasoline from the tank is bad for us. Maybe we should create a "sippy cup" attachment for the tank cap.
By that logic, all cars should be banned as well. I mean a baby could potentially start the car and suck on the tailpipe and get undesirable "second hand smoke." Speaking of poisoning, what about the #2 lead pencils in our schools? That needs to be addressed as well. We have so many laws that kids cannot be kids anymore. All children need a law degree just to know what they can do. When was the last time you saw a merry-go-round or a see-saw? My daughter doesn't even know what they are, because some "do gooder" nation with way too much time on their hands decided that those were dangerous.

Hi Malcolm,
I have been following this through Cycle News, Cycle World, and Dirt Rider and am getting so tired of Government protecting us from ourselves at our cost. From non-cancerous Asbestos at Clear Creek, to children at risk from non-consumable lead based products. I believe we are in a recession (if I'm not mistaken), so raising sales tax, and restricting sales of any kind does not add up to anyone with the most minimal of business sense. This needs to be back burnered for a time when companies are not going out of business, and unemployment is declining. I hope that this can be resolved before more business' go under, as this is a tough time for the power sports industry without adding another hurdle. I am glad you are making a stand and I support you 100%. Somebody needs to stop the madness and make a presidence that this kind of governing is flat out unacceptable. Right now these economical burdens are a bigger risk than terrorism.

Comments: Good on you. This whole thing is silly. I watched 32 kiddos start a youth snow cross event in West Yellowstone last weekend all on 120 sleds. Everyone of them had the time of they're lives. They all walked around proudly with the medals they earned all weekend.
I never saw one of them try to eat the sled, no matter how hungry they were. Congress needs to worry about real problems, we have enough of them.

Tester introduces ‘Dirt Bike Bill’

‘Common sense’ bill makes exceptions to Consumer Product Safety Act - Monday, March 16, 2009

(WASHINGTON, D.C.) – Senator Jon Tester today introduced legislation that will once again allow motorsports dealers to sell dirt bikes, all-terrain vehicles and parts for use by young people.

Tester’s bill changes the Consumer Product Safety Act, which President Bush signed into law last fall.

The Consumer Product Safety Act is designed to keep dangerous products, like toys that contain high levels of lead, away from children.

But many have criticized the law for over-reaching. It has forced many motorsports dealers and repair shops to stop selling common vehicles like dirt bikes and ATVs for use by children because the vehicles contain internal, unsealed lead parts. As a result, some parents are allowing their children to ride unsafe, adult-sized vehicles.

Tester’s bill, called the Dirt Bike Bill, makes two exceptions to the Consumer Product Safety Act:

“This is a common sense piece of legislation that will open the doors again to families that consider motorsports a part of life in Montana,” said Ed Staack, owner of Staack’s Motorsports in Butte. “Nobody wants our kids exposed to lead toys, but kids also don’t go outside and eat their dirt bikes. Jon understands that and is doing something about it.”

“If something’s broken, we Montanans want it fixed,” said Tester, who is currently Vice Chairman of the Congressional Sportsmen’s Caucus. “And right now the Consumer Product Safety Act needs fixing. My bill will protect small businesses and allow families better, safer access to the outdoors.”

Tester’s Dirt Bike Bill is formally known as the Common Sense in Consumer Safety Act.
